Understanding Trademark & Copyright in Print on Demand (POD)

Before selling T-shirts or other POD products, you must understand trademark and copyright laws to avoid legal issues and account bans (especially on Merch by Amazon, Redbubble, or Etsy).

🔍 1. Difference Between Trademark & Copyright

Who Registers It?Businesses & BrandsArtists, Writers, Creators

🚨 Key Rule:

  • You cannot use trademarked words like "Nike", "Marvel", or "Star Wars" in your designs or descriptions.
  • You cannot copy someone else's artwork, logos, or copyrighted images.

🔎 2. Where to Check for Trademarks?

Before uploading a design, always check if the niche has trademarked words or phrases.

🛠️ Free Trademark Search Tools:

1️⃣ USPTO (USA) – Official Database:

  • Search for exact words or phrases (e.g., "Dad Life")
  • If LIVE, it's an active trademark ❌ Avoid using it.

2️⃣ EUIPO (Europe) – European Trademarks:

3️⃣ TMview (Worldwide Trademarks):

4️⃣ Trademarkia – Easier Search for USA & Global Trademarks:

5️⃣ Merch Informer Trademark Checker (For Merch by Amazon sellers)

💡 Example Search:

  • If you search "Super Dad", and it is LIVE on USPTO, you CANNOT use it in your design or title.
  • If "Super Gaming Mode" has NO trademarks, it is safe ✅.

📜 3. Where to Check for Copyright?

Copyright applies to logos, characters, photos, music lyrics, books, movies, TV shows, etc.

How to Check If a Design or Image is Copyrighted?

1️⃣ Google Reverse Image Search

  • Upload an image or search by keywords.
  • If the image appears on Pinterest, Redbubble, or ArtStation, it may be protected ❌.

2️⃣ US Copyright Office (USA) – Search for Registered Works

3️⃣ Copyright Watchdog (For Artists & Brands)

🚨 Never Use These in Your Designs:
❌ Disney Characters (Mickey Mouse, Marvel, Star Wars)
❌ Famous Logos (Nike, Adidas, Coca-Cola)
❌ Movie Quotes ("I'll be back" – Terminator)
❌ Music Lyrics (Any song from Taylor Swift, Drake, etc.)
❌ Celebrity Names & Faces (Elon Musk, The Rock)

What You Can Use?
Original Art & Graphics (created by you)
Public Domain Images (Older than 100 years, e.g., Da Vinci paintings)
Creative Commons Images (With proper license & credit)

⚡ 4. How to Organize Work for Faster Trademark & Copyright Checks?

If you are checking multiple niches daily, you need a system to work fast and avoid mistakes.

🛠️ Create a Niche Validation Sheet (Google Sheets / Excel)

Niche IdeaTrademark Checked?Copyright Checked?BSR Demand?Safe to Use?
"Funny Cat Dad"✅ No Trademark✅ No Copyright Issues🔥 Yes (High Sales)✅ Safe
"Marvel Hero Shirt"❌ Trademarked❌ Copyright Issue❌ No (Risky)❌ Avoid

🔥 Pro Tip:

  • ✅ Use Conditional Formatting in Google Sheets (Green = Safe, Red = Risky).
  • ✅ Save official links to trademarks & copyright records.
  • ✅ Store rejected ideas to avoid checking them again later.

⏩ 5. What If You Accidentally Upload a Trademarked or Copyrighted Design?

Merch by Amazon, Redbubble, Teespring Penalties:

1️⃣ First Warning → Your design is removed.
2️⃣ Second Violation → Account suspension risk.
3️⃣ Multiple ViolationsPERMANENT BAN from the platform.

💡 What to Do?

  • If Amazon removes a design, delete it everywhere (Etsy, Redbubble, etc.).
